زكاة الفطر بين الطعام والقيمة ـ دراسة فقهية مقارنة

Abstract

    يدور موضوع هذه الورقة حول مسألة إخراج زكاة الفطر عينا أم نقدا ومع إثارة هذه المسألة كلما اقترب موعد إخراجها تساؤلات في أذهان العامة وتجادبا كبيرا في الآراء واختلافها مما خلق تشويشا في عقولهم، وأفكارهم وجعلهم فرقا متضادة، كل يتعصب لقوله ورأيه، ومن الأسباب الرئيسة التي دعتنا إلى كتابة هذا البحث ازدياد وتيرة هذه التجاذبات بسبب التعصب وعدم الفهم الجيد للمسألة، وبسبب تقليد بعض الفتاوى التي لم يراع أصحابها مقاصد الشريعة الإسلامية وأسرارها وحكمها، وعلى الرغم من أن المسألة ظنية من مسائل الاجتهاد التي لا تقبل التحجير، فلم يغفلها العلماء قديما وحديثا وتعرضوا لها بالشرح والتوضيح، لذا ارتأينا أن نتعرض لهذه لمسألة بجهدنا المقل وأن نسلك فيها الجانب العلمي بأسلوب منهجي ينهج الحيادية التامة ما استطعنا إلى ذلك سبيلا، مسلكنا في ذلك جمع شتات هذه المسألة من مضانها، مؤصلين ومدللين بما يتماشى مع مقاصد الشريعة ومسلك التيسير فيها، بأن لا يتعارض مع نصوصها ومدلولاتها، ويهدف هذا البحث إلى بيان حكم إخراج القيمة في زكاة الفطر، وتكمن إشكالية البحث في بيان إظهار مسلك العلماء فيما ذهبوا إليه في هذه المسألة وبيان صحة ما ذهب إليه كل فريق، وان هذا الخلاف له وجه صحيح في الشريعة منعا لما يحصل بين الناس من شقاق حول هذه القضية، من نتائج الدراسة أن إخراج القيمة في زكاة الفطر جائز في الشريعة الإسلامية.

Abstract

This paper addresses the issue of whether Zakat al-Fitr should be paid in kind or in cash. As the time for its payment approaches, this question arises in the minds of the public, sparking considerable debate and differing opinions. This has created confusion and divided people into opposing factions, each clinging to their own viewpoint. One of the main reasons for writing this research is the increasing frequency of these debates, fueled by prejudice, a lack of understanding of the issue, and the blind following of certain fatwas that disregard the objectives, wisdom, and underlying principles of Islamic law. Although this is a matter of scholarly interpretation (ijtihad) that cannot be arbitrarily restricted, scholars, both past and present, have addressed it with explanation and clarification. Therefore, we have chosen to tackle this issue with our limited effort, adopting a scientific approach and maintaining complete neutrality to the best of our ability. Our method involves gathering the scattered information on this issue from its various sources, providing foundational and substantiated arguments that align with the objectives of Islamic law and its principle of facilitation. This research aims to clarify the ruling on paying the monetary value of Zakat al-Fitr, ensuring it does not contradict its texts and meanings. The research problem lies in demonstrating the scholars' approaches to this issue and clarifying the validity of each group's position. It also aims to show that this difference of opinion has a sound basis in Islamic law, thus preventing discord among people regarding this matter. One of the study's findings is that paying the monetary value of Zakat al-Fitr is permissible in Islamic law.
